Terms of Service

• By accessing and using Yaltopia Homes, you accept and agree to be bound by these Terms of Service and our Privacy Policy.
• If you do not agree to these terms, you may not use our platform.
• We reserve the right to modify these Terms at any time. Material changes will be notified via email or in-app notice at least 7 days before taking effect where reasonably practicable.
• Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.

• You must be at least 18 years old and legally capable of entering into binding contracts under Ethiopian law to create an account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate, current, and complete information during registration and to keep it updated.
• You must notify us immediately at support@yaltopia.com of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or are used fraudulently, with or without notice depending on severity.

• You agree not to use the Platform for any unlawful purpose or in any way that could damage, disable, overburden, or impair the service.
• You will not post false, misleading, fraudulent, or duplicate listings.
• You will not upload content you do not have the legal right to use, including photos, floor plans, or descriptions belonging to third parties.
• You will not attempt to gain unauthorized access to any part of the Platform, scrape data at scale, or reverse-engineer our systems.
• You will not use the Platform to harass, defraud, or discriminate against other users on any legally protected basis.
• You are solely responsible for complying with all applicable Ethiopian laws relating to property rental, sale, taxation, and disclosure.

• Property owners and agents are solely responsible for the accuracy, legality, and completeness of their listings, including title, zoning, and permit status.
• All property information — photos, descriptions, prices, and availability — must be accurate and current at time of posting.
• We reserve the right to review, verify, edit, suspend, or remove any listing at our sole discretion, including before publication.
• Verification badges (e.g., "Verified Agent," "Verified Listing") indicate that Yaltopia has performed limited checks (e.g., document review) and do not constitute a guarantee of title, condition, or legality of the property.
• Property owners and agents represent and warrant that they have the legal right to list, rent, or sell the property in question.

• Yaltopia Homes' current fee structure (if any commission, subscription, or featured-listing fee applies) will be disclosed to users at the point of the relevant transaction and may be updated with notice.
• Yaltopia Homes is not a party to, and does not process, rental or sale payments between users unless explicitly stated within a specific paid feature; payment terms for such rentals/sales are agreed directly between the parties.
• Where Yaltopia does process payment (e.g., for premium features), such payments are handled via a third-party payment processor and are subject to that processor's terms as well.
• Fees paid to Yaltopia for platform features (e.g., featured listings) are non-refundable except as required by law or explicitly stated at time of purchase.

• Bookings are subject to availability and confirmation by property owners or agents.
• Cancellation policies vary by property and are specified in each listing; see our Cancellation Policy.
• Yaltopia Homes acts solely as a platform connecting users and does not own, manage, inspect, or guarantee any property listed.
• All rental/sale transactions, negotiations, and agreements occur directly between users; Yaltopia Homes is not a party to, and assumes no liability for, any such agreement.
• We strongly recommend verifying ownership and inspecting any property in person before making any payment — see our Safety guidelines.

• All Platform content — logos, design, software, and Yaltopia-authored text — is the property of Yaltopia Homes or its licensors and may not be reproduced without permission.
• By posting content (listings, photos, reviews, messages) on the Platform, you grant Yaltopia a worldwide, royalty-free, non-exclusive license to host, display, reproduce, and distribute that content for the purpose of operating and promoting the Platform.
• You represent that you own or have permission to use any content you upload.
• Intellectual property complaints: If you believe content on the Platform infringes your copyright or other IP rights, email legal@yaltopia.com with (a) identification of the work claimed to be infringed, (b) the URL/listing in question, (c) your contact details, and (d) a statement of good-faith belief that use is unauthorized. We will investigate and may remove content pending review.

• The Platform, and all listings and information on it, are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
• We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that any listing, price, or availability information is accurate or current.
• We do not warrant the identity, conduct, or trustworthiness of any user, property owner, or agent.

• To the maximum extent permitted by Ethiopian law, Yaltopia Homes and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Platform.
• Our total aggregate liability for any claim arising from these Terms or your use of the Platform is limited to the greater of (a) the amount you paid to Yaltopia Homes in the 12 months preceding the claim, or (b) 5,000 ETB.
• We are not liable for disputes, losses, or damages arising between users, property owners, or agents, including fraud committed by another user.
• Nothing in these Terms limits liability that cannot be limited under Ethiopian law (e.g., liability for fraud or willful misconduct by Yaltopia itself).

You agree to indemnify, defend, and hold harmless Yaltopia Homes, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your listings or content; (c) your violation of these Terms; (d) your violation of any law or third-party right; or (e) any transaction or dispute with another user.

• Informal resolution first: If you have a dispute with Yaltopia Homes, please contact legal@yaltopia.com and allow 30 days for us to attempt to resolve it informally before pursuing other remedies.
• Governing law: These Terms are governed by the laws of the Federal Democratic Republic of Ethiopia, without regard to conflict-of-law principles.
• Jurisdiction: Any dispute not resolved informally shall be subject to the exclusive jurisdiction of the courts of Addis Ababa, Ethiopia, unless a different forum is required by mandatory consumer-protection law.
• Disputes between users (e.g., renter and landlord) are the responsibility of those users; Yaltopia may, but is not obligated to, assist in good faith.

• We may suspend or terminate your account immediately, without prior notice, for conduct that violates these Terms or applicable law.
• Upon termination, your right to use the Platform ceases immediately; certain data may be retained per our Privacy Policy and applicable law.
• Sections that by their nature should survive termination (e.g., Indemnification, Limitation of Liability, Dispute Resolution) remain in effect.

• Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disaster, internet/power outages, government action).
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
• No Waiver: Our failure to enforce any right or provision is not a waiver of that right.
• Assignment: You may not assign these Terms without our consent; we may assign them freely (e.g., in connection with a merger or sale).
• Entire Agreement: These Terms, together with our Privacy Policy, Cancellation Policy, and Safety guidelines, constitute the entire agreement between you and Yaltopia Homes.
